Tachograph and fines for its absence

According to the definition given in Federal Law No. 196-FZ “On Road Safety” dated 10.12.1995, a tachograph is a device that records information about the speed and route of vehicles, as well as the work and rest schedule of drivers. It is not mandatory for installation for all vehicles, so private carriers do not need to think about the fine for the absence of a tachograph in 2023.

The list of vehicles where such a device must be installed is contained in two regulations: Order of the Ministry of Transport of the Russian Federation dated October 28, 2020 No. 440 “On approval of requirements for tachographs installed on vehicles, categories and types of vehicles equipped with tachographs, rules for the use, maintenance and control of tachographs installed on vehicles” and Resolution of the Government of the Russian Federation dated March 30, 2019 No. 382.

According to them, a special device must be present:

in buses and minibuses with a capacity of more than 8 passengers (in addition to the driver), which carry out regular transportation of citizens
in urban, suburban and intercity traffic, including for the organization’s own needs;
trucks;
passenger and cargo trolleybuses;
specialized vehicles, including ambulances, fire trucks, truck cranes, tow trucks, vehicles used for training and passing exams for driver’s licenses.

If a vehicle is classified as a category where recording the duration and parameters of work is mandatory, but there is no special device for this, the Code of Administrative Offenses of the Russian Federation provides for liability for the absence of a tachograph on a truck or in passenger transport. Traffic police officers can establish that there is no recording device when checking documents and the car.

According to the Code of Administrative Offenses of the Russian Federation, Article 11.23. “Driving a vehicle or releasing a vehicle on the road without a tachograph, failure to comply with the standards for driving and rest time, or violation of the work and rest regime for drivers” driving or releasing a vehicle on the road without a tachograph shall entail the imposition of an administrative fine in the amount of 3,000 (three thousand) to 50,000 (fifty thousand) rubles.

Where to get a driver card?

Driver, enterprise, and workshop cards can be obtained from manufacturing organizations included in the relevant lists published on the official website of Rosavtotrans, in the section “Russian Federation Tachograph Control System”.

What is the validity period of the driver card?

Driver cards are valid for no more than three years. Workshop cards are valid for no more than one year. Enterprise cards are valid for no more than three years.

Where can a tachograph be installed?

Domestic transportation with ETSR tachograph?

They can’t. To carry out domestic transportation, it is necessary to install a tachograph with a CIPF unit.

According to the order of the Ministry of Transport of Russia dated February 13, 2013 No. 36, vehicles of categories M2, M3, N2, N3 are subject to mandatory equipment with tachographs, regardless of the type of transportation performed.

I have a GPS terminal installed, do I need a tachograph?

Only the tachograph, which records the work schedule of a specific driver who has the appropriate card, monitors the driver’s compliance with the driving, work and rest regimes.
